Mission
The Trust was created in 2012, by Commander Iain, on the recommendation of the Clan Treasurer, Finlay McFee. Iain and Finlay then became the first trustees.
The fundamental objective was to bring into being a legal entity separate from the person of the head of the clan, (Commander or Chief), capable of lawfully holding assets on behalf of the Clan societies and clansfolk. That being the entire folk of the Clan as broadly defined as possible.
Without this there is no alternative other than the head of the clan personally owning all the assets directly, thereby making them subject to his or her personal tax situation, and inheritance provisions.
During an interregnum, that is, when the Clan is without a Commander or Chief, the Trust also becomes very useful as we still remain capable of managing our finances in real world terms. This allows us to organise the Conventions required by the Lyon Court to appoint a new head of clan, and to organise and hold International Gatherings, and indeed to do normal things financially on behalf of the entire Clan.
When there is a head of clan, that person has the right to chair the trustees if they wish to do so, which essentially gives a blocking power to the clan head. In all other respects Head of Clan is a trustee just like each of the others.
The significance of the Trust is directly proportional to the scale of assets it holds. And so far these are and have been, modest, deriving from the funds passed on when Sandy retired as Commander. We are also capable of holding artefacts and land or buildings, and have just recently taken custody of the Clan archive.
The trusteeship was expanded in early 2019 with the addition of Par-Magnus Hagman MacFie and of Andrew Duffy. Commander Iain simultaneously resigned as a trustee due to his poor health. Sadly, Andrew passed away in the spring of 2026. We are now faced with the challenge of broadening the trusteeship in order to preserve its UK tax
resident status, and this is presently under way.
The Trust is ready to receive donations, bequests, or endowments, from the folk of the clan as they may see fit. The Trust Deed explicitly envisages and allows flexible custom arrangements to be made for handling large donations particularly those made with charitable intent. The Trust itself, however is not a charity.
